Terms of service

Welcome to Ampersart. These Terms of Service ("Terms") govern your use of ampersart.com and any purchase you make through it (the "Site"). Ampersart is operated by Juliet Bautista.
By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who can order
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet this requirement and that the payment information you provide is your own or that you are authorized to use it.
2. Products, prices, and availability
We do our best to describe and photograph our work accurately. Colors, paper texture, and finish can appear differently across screens, and small variations between the image on your screen and the piece you receive are a normal part of fine art printing.
Original paintings are unique works. Once sold, they are no longer available.
Prices are listed in the currency shown at checkout and may change at any time before an order is placed. We reserve the right to correct pricing or description errors, and to limit or refuse any order.
3. Placing an order
Your order is an offer to purchase. A confirmation email acknowledges that we received it — it does not mean the order has been accepted. Acceptance happens when the order enters production or ships.
We may cancel an order before that point, including for pricing errors, payment issues, suspected fraud, or unavailability. If we cancel, you will be refunded in full.
4. Changes to your order after purchase
Orders move into production quickly, and once a piece is being made it cannot be changed.
Changes and cancellations can only be accommodated before your order enters production — often within about 12 hours of purchase. Email shop@ampersart.com as soon as possible and we will always try, but we cannot guarantee we will reach the order in time.
Please double-check before completing your order that:
- Your shipping and billing addresses are correct
- You have selected the exact piece you want
- You have chosen the correct option, framed or unframed
- You have chosen the correct size
Once an order has shipped, no changes are possible.
5. Payment
Payment is processed by Shopify and its payment partners. We do not store your full payment card details. You are responsible for any bank fees, currency conversion charges, or overdraft costs your payment method may apply.
6. Shipping, returns, and refunds
Shipping timelines, delivery, and customs are covered in our Shipping Policy. Returns, cancellations, damaged orders, and refunds are covered in our Return & Refund Policy. Both are part of these Terms.
7. Intellectual property
All content on this Site — including artwork, paintings, photographs, prints, poems and other writing, product descriptions, page copy, design, and the Ampersart name and logo — is the original work of Juliet Bautista and is protected by copyright and other intellectual property laws.
Purchasing a print or an original painting transfers ownership of that physical object only. It does not transfer copyright or any reproduction rights. You may not reproduce, scan, photograph for resale, print, publish, distribute, license, or create derivative works from any piece, in whole or in part, without written permission.
Personal enjoyment and display in your home are of course welcome. Sharing a photo of the work in your space on social media is welcome too. Commercial use of any kind is not permitted without a license.
You may not use any content from this Site to train machine learning or artificial intelligence models.
8. Using the Site
You agree not to use the Site to break the law, infringe anyone's rights, transmit malicious code, scrape or harvest data, interfere with the Site's operation, or attempt to gain unauthorized access to any part of it.
9. Reviews and submissions
If you send us a review, photo, comment, or other material, you grant us a non-exclusive, royalty-free license to use, display, and share it in connection with Ampersart, including on our website and social media. You confirm the material is yours to share and does not infringe anyone else's rights. We may decline to post or may remove any submission.
10. Third-party links and services
The Site may link to or rely on third parties, including our print partner, our newsletter provider, and payment processors. We are not responsible for the content, policies, or practices of third-party sites and services.
11. Disclaimers
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the fullest extent permitted by law, Ampersart and Juliet Bautista will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Site or any purchase.
Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Nothing in these Terms limits any rights you have under mandatory consumer protection laws in your country, including in the European Union and United Kingdom.
13. Indemnification
You agree to indemnify and hold harmless Ampersart and Juliet Bautista from any claims, losses, or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
If you are a consumer in the European Union or United Kingdom, this does not deprive you of the protection of the mandatory laws of your country of residence.
15. Severability and changes
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
We may update these Terms from time to time. The updated version will be posted here with a revised date, and applies to orders placed after that date.
